Terms of Service

1. Overview

These Terms of Service (“Terms”) govern your use of the UnionStack platform and services provided by UnionStack GmbH, Friedrichstraße 123, 10117 Berlin, Germany (“UnionStack”, “we”, “us”).

By accessing or using our services, you agree to these Terms.

2. Services

UnionStack provides enterprise email, collaboration, security, and endpoint management services hosted exclusively within the European Union. Our services include:

  • Email and calendar
  • Document collaboration
  • Video conferencing
  • Team messaging
  • Endpoint device management
  • Security and compliance tools

3. Account Registration

To use our services, you must:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorised access
  • Be at least 18 years old or have authorisation from your organisation

4. Acceptable Use

You agree not to:

  • Violate any applicable laws or regulations
  • Send spam or unsolicited commercial communications
  • Distribute malware or malicious content
  • Attempt to gain unauthorised access to our systems
  • Use our services for any illegal purpose
  • Resell or redistribute our services without authorisation

5. Data Ownership

Your data belongs to you. We do not claim ownership of any content you create, upload, or store using our services. You retain all intellectual property rights to your content.

6. Service Level Agreement

We commit to the following service levels:

  • Starter plan: 99.9% uptime
  • Business plan: 99.95% uptime
  • Enterprise plan: Up to 99.99% uptime (as agreed in your contract)

Uptime is measured monthly, excluding scheduled maintenance windows.

7. Data Protection

We process customer data in accordance with our Data Processing Agreement (DPA) and GDPR. All data is stored exclusively in EU data centers.

8. Payment Terms

  • Fees are billed monthly or annually in advance
  • All prices are in EUR and exclude applicable VAT
  • Payment is due within 30 days of invoice
  • We reserve the right to adjust pricing with 90 days’ notice

9. Term and Termination

  • Monthly plans may be cancelled at any time with 30 days’ notice
  • Annual plans run for 12 months and renew automatically
  • We may terminate for material breach with 30 days’ written notice
  • Upon termination, you may export your data for up to 30 days

10. Limitation of Liability

To the maximum extent permitted by law, our total liability shall not exceed the fees paid by you in the 12 months preceding the claim. We are not liable for indirect, consequential, or incidental damages.

11. Governing Law

These Terms are governed by the laws of the Federal Republic of Germany. The courts of Berlin shall have exclusive jurisdiction.

12. Changes

We may update these Terms with at least 30 days’ notice. Continued use of our services after changes take effect constitutes acceptance.
